The Friday Review

Another week went by at the speed of light!

The Good

Cliff Ennico and I sent in the final round of major edits on The eBay Marketing Bible - now the book is put together and we get one final look at it before it goes to press. Release date June 2009. Yahoo!!!!!! I am so happy to have it mostly ‘in the bag’ It has been a big project. I want to say Cliff was THE BEST to work with. I couldn’t have been luckier to co-author this book with him.

It’s looks like eBay “almost live’ in Las Vegas this June is a go. The dates are not set yet, sometime late in the month. eBesty asked if I’d like to talk about photography, so looks like I have a good excuse to go play in Vegas baby ;-)

The Bad

Well, really not to much went wrong this week – although I am staring at the most intimidating questionnaire from Amacom’s PR department. I have to get it completed soon.

What Do You Do When A Seller Steals Your Photos

After all this talk the last few weeks about how the eBay Trust And Safety team removes listings first, asking questions later…. I’d like to tell you that if there’s a instance where you are the victim of someone violating your rights it’ll be taken care of quickly…. but…..

Not so fast there McGraw!

I can now say that I’ve had experience on both sides of the eBay Trust & Safety department. And I can tell you how amazed I am that this department seems so unresponsive. Maybe it’s because I called them the Keystone Cops the other day – but I doubt they ever heard – LOL.

My issue this time is over another seller who ‘borrowed’ a picture of mine. Well, actually it was an eBay Store Certified Designer Logo I have been authorized to use. You can see it on my website at www.clovercity.com. Normally, I really wouldn’t care if someone ‘right clicked’ and saved the logo to their hard drive.

But, this seller – took it a step further. Instead of saving it and then uploading it to the eBay picture services, or to Photobucket she directly linked to my site – stealing my ‘bandwidth.’ While not the worst thing ever, it is considered  bad manners on the Internet to cyber squat like that.

So, I wrote the seller and asked her to remove the links. She wrote back, apologized and said someone had told her that was the correct way to host photos. (I think she really got a few wires crossed). She promised she’d remove them but could I please give her a couple of days. So, I wrote back told her how to use photobucket to host her photos and told her she had two weeks to remove the links.

Two weeks later, the seller had used my suggestion about Photobucket on her new listings, but never removed the links from her existing listings – about thirty listings.

I think I was fair with her, giving her two weeks. So I was slightly annoyed – and felt very used-  that she continued to list new products without fixing the old listings – so yes, being human – I reported all the listings to the eBay Trust and Safety department. I received an auto-reply instantly and a week later – nothing had been done… umm, so much for the Trust & Safety department helping the little guy.

Luckily, in an instance like this – it’s better to get creative than to get mad. So, because she is ‘pointing’ her listing to an image on my website – I can change  a few things. I went to work creating a new graphic (see above) and renamed it the original logo’s name. Before I uploaded the new graphic to overwrite the old, I renamed the original graphic and and changed the name on the URL that points to it.

The result: an invite to learn eBay to everyone who visits this sellers listings, complete with my URL.

I don’t have a solution for you if you find your photos are being borrowed and eBay Trust & Safety isn’t responding, except to suggest that you watermark each of your images. If they do get used by someone else, your branding will be all over them. The person borrowing them will look like a loser and you’ll be marketing your business.

Remember, it’s always good business to try and keep a level head. You don’t want to end up looking like a jerk because someone else is getting away with something you know is wrong. Yes, it’s frustrating – but it’s very bad business to look like a sore looser. I’ve heard of sellers changing the graphics to say something like “this seller is a bandwidth thief” Yes, that’s true, but really people who see the post – think worse of you then the offender.

If possible, try to turn the situation around to your benefit. Now, I get a smile when I see those links showing up in my report – means more people are seeing my ad.

You Can Win – How I Got An eBay VeRO Retracted Twice!

This is a follow up post on my recent VeRO violations. I want to let you know that got it removed – YEAH! It took persistence, but it paid off in the end.

The reason why I’m bragging is I want you to fight too if you feel you’ve had an unfair VeRO. You must remember that these violations, in many cases are a subjective call, not hard evidence. In my opinion the VeRO department is full of untrained employees who seem more like the KeyStone Cops than mediators looking for the truth. And, if you don’t fight and receive too many violations eBay removes your PowerSeller Status or worse they kick you off the site.

I know most people are ashamed of these violations, even if they didn’t do anything wrong – and I suspect we just sweep them under the carpet without much of an outcry. Well, that thing about the ‘meek shall inherit the earth’ is wrong here. I had to be obnoxious and not let it drop. I kept writing to Skyler, Gilmar, Jayceon, Archibald, Garrett and the rest of the eBay Trust & Safety team. I also wrote the company that complained that I was ‘stealing their copy’ (which I was not – I was using manufacture approved wording).

I waited the specified five working days that the company had to respond and when no email response came – I wrote back to eBay. The Trust & Safety team then contacted the company, which forced them to contact me. When they responded here’s the exact wording as to why the filed a VeRO complaint: “Most likely we felt that your item:
220205692646 – eBay Photo Studio Kit Includes Cube Lights EZ Seminar infringed on (text and copy) one of our XXXXXXX (
I’m protecting their name here)  lighting kits or tents.”

Notice the words: most likely we felt – I’m sorry, but if they couldn’t prove that I was in violation I consider it harassment. Which is exactly what I wrote back to the company. Who, assured me that they were not in the business of harassment and would contact eBay about removing the strike. They did! eBay sent me an email that the listing was returned to my unsold items and a few days later my seller dashboard cleared.

The lesson here – is that you must be persistent and be a bit of a jerk about not accepting these sorts of claims.

Previously I had a VeRO violation because I used the word ‘Style’ in my title to describe an Attache’ Case. It took about ten emails, but someone in the VeRO department finally sided with me and had the violation removed.

On a third occasion (yes, even eBay Certified Business Consultants have lots of these VeRO’s) I unwittingly added some Mrs Grossman stickers to a lot of Creative Memories stickers and in the title referred to it as a “lot of Creative Memories Scrapbook Stickers.” Well, Creative Memories had the listing shut down faster than a speeding bullet! And, because I agreed it was slightly misleading, and something I never intended to do was to mislead a buyer, I let the VeRO go. That is, until I started getting threatening emails and an official letter from the Creative Memories lawyer who threatened a lawsuit if  I refused to sign the letter saying I’d never sell Creative Memories again. All this over one little lot of scrapbook stickers on eBay.

Well, the continued bombardment from the lawyer sent me over the bend and I finally sent her an email. In the email I told her that she was ‘harrassing’ me and that I wanted it stopped. Guess what… she wrote back and said she’d never ‘harrass anyone’ and that was the last I heard from her.

So, again I know this is a long post – but I’m trying to get across to you that you do have rights, and you should fight in these cases. Don’t allow some minimum wage employee (probably from India) to push you around. Yes, it’s humiliating a to receive a VeRO violation (we’re all honest and don’t intend to break any rules) – but don’t sweep it under the rug or your competitors will start treating you like a carpet.

The Friday Roundup

Another Friday, already.

The Good

Last weekend my sales started picking up. While I wouldn’t call it stellar, the uptic is welcome. So, far the trend is continuing through this week. Let’s hope the momentum continues. How have your sales been this week? Please comment.

I talked to CJ Jacinto from XOXMAS today – she shared her outline for the DVD class on Product Sourcing. I’m pretty excited, she really knows her stuff! We’re getting closer to recording it. We decided to forgo the live class for now. We heard from people that they are interested but that no one can make a Monday night class. So, we’ve decided to go directly to DVD. Which means more people will have access to her great information on how to buy products to resell online.

The Bad

All in all, this has been a rough week.

 I teach a five week class on digital cameras. This weeks lesson was transferring the images from the camera to computer. What normally takes a few minutes to teach turned into a two hour flop! I couldn’t figure out where the photos were being sent once they left the cameras -the class computers assigns everyone a virtual desktop on the network and I just couldn’t get my mind wrapped around where to find the photos. Oops – I’m suppose to be teaching everyone how easy digital cameras are…. LOL

Then my car went to the shop – which, while expensive has turned out OK. I’ve been forced to stay home, sit in front of my computer and get a few chores done I’ve been avoiding.

Yesterday I talked Dany Byrne from Ghostleg.comto do a quick tutorial on how to buy a computer. It was suppose to last about 15 to 20 minutes but everything went wrong. Dany patiently slogged through with me. Finally done with the interview two hours later, I went to hit the ‘save’ button on the video and we found that none of it was recorded….

I received this email from eBay Mainstreet. From the mess I had this year collecting and reporting sales tax based on buyer location in just my home state – I can tell you having a tax we sellers must collect and report would be a nightmare. Many of us would sink under the additional paperwork, not to mention the extra charges we’d have to pass along to our customers.

Internet Sales Taxes–Your costs go up. Your buyers’ costs go up. You are required to comply with the same tax laws as the nation’s largest retailers. This scenario could soon become reality.

The sales tax laws governing today’s Internet and catalog retailers are simple: If you sell something to a person living in your state, you collect sales tax. If that customer doesn’t live in your state, you don’t collect the tax. However, a number of state governments and the biggest retail giants in America are planning an aggressive lobbying campaign to change the law. They want to require small retailers to operate like the biggest retail chains, collecting taxes everywhere.

We all know times are tough and state governments are looking for more tax money. Likewise, big retailers see an opportunity to gain a competitive edge by imposing new costs and higher prices on their smallest competitors. Luckily, the tax ground-rules can’t be changed without congressional action. There’s still time to stand up and be counted.
